Zune Privacy Statement Supplement

Note that this page is a supplement to the Microsoft Online Privacy Statement . In order to understand the data collection and use practices relevant for a particular site or service, you should read both the Microsoft Online Privacy Statement and any applicable supplement.

Scope

Zune is an interactive media and social experience that includes the following core features:

  • Zune Devices - Zune branded portable media players, Zune branded experiences on mobile phones and Zune branded experiences on the Xbox console
  • Zune Marketplace – the service that offers media that you can preview, download, or stream
  • Zune Social – the community and services of Zune users that share and discuss their media experience
  • Zune Software for the personal computer (“Zune PC Software”) – the software application that provides access to Zune services using a personal computer
  • Zune.net – the website that provides access to Zune services online

Not all features described below are available on all Zune Devices. Zune Marketplace may not be available in your country of residence.

 

Zune Tag

Each Zune account has a related Zune tag. You have the option to create a Zune tag or, if you have an existing Xbox LIVE account associated with the Windows Live ID you are using for your Zune account, then your Zune tag will be your existing Gamertag. If you are creating a new account from Windows Phone, your Zune tag will be auto-generated, which you can later change. Since the Zune tag may be publicly displayed, you should not use your personal information as your Zune tag.

 

Content Usage Statistics

To enable the sharing experience on the Zune Social and help you discover content that may interest you, the Zune PC Software and Zune Devices will collect information about what content you play, the length of play and the rating you give. This information is sent to Microsoft from your Zune PC Software or directly from your Zune Device.

To change the setting for this feature from Zune.net go to My Account>Update Privacy Settings or from the Zune PC Software go to settings > account > Summary >privacy settings and clear or enable the checkbox for “Personalize Your Zune Experience.” If you signed in as a child account, this would be called “Family Settings” and will require a parental sign in to access the setting.

To change this setting from the Xbox console, go to the Zune music experience on the Music Marketplace and select me>Zune Account Management>privacy settings and choose the “Personalize Your Music” setting.

 

Smart DJ & Mixview

To enable the Smart DJ & Mixview features, identifiers for the music in your collection are sent to Microsoft to generate Smart DJ playlists & provide the Mixview feature. If you do not want identifiers for the music in your collection to be sent to Microsoft, in the Zune PC Software, go to settings > software >Metadata and Ratings> Media info and clear the “Automatically retrieve and update album art and metadata” checkbox.

 

Automatic Retrieval of Media Information

To enrich your experience when playing content, the Zune PC Software and/or Zune Device may display related information about the content you play and the content in your Zune library, such as the album title, cover art, song or video title, and other information, where available. This information may be automatically downloaded and stored with the content in your library or accessed through the internet. When you play or browse content, the Zune PC Software and/or Zune Device displays the related information.

To download this information, the Zune PC Software sends an information request to Microsoft containing standard computer information, such as your computer’s IP address, operating system version, Zune PC Software version, a code that identifies the manufacturer of your computer, your regional and language settings, and an identifier for the content. The Zune PC Software will store the resulting information in your content library for future use. Similarly, the Zune Device sends wirelessly an information request to Microsoft containing device information, such as device IP address, device software version, regional and language setting, and an identifier for the content.

To change the setting of the downloadable feature in the Zune PC Software, go to settings > software > Metadata and Rating> Media info. To change the downloadable and internet access setting of this feature on your Zune Device, change your wireless setting by going to settings >wireless; however your Zune Device may also download information when connected to the Zune PC Software. If you do not want to connect to the Zune service to download this information when playing or browsing music on Windows Phones, go to Settings>application>music + videos and toggle the “Connect with Zune ” switch to “Off.”

 

Social Sharing

You may show the Zune community your Zune profile, your friends list, what you have recently played, favorite and most played artists, and the details of your participation (including your comments, forum posts, and friend confirmations) on the Zune Social. This information may be displayed on your user profile page and elsewhere in the Zune Social. Showing your Zune profile and social activities can help you connect with other members of the Zune community with similar interests. To change the settings of these features from Zune.net, go to My Account>Update Privacy Settings or from the Zune PC Software go to settings > account > Summary >privacy settings. If you signed in as a child account, this would be called “Family Settings” and will require a parental sign in to access the setting.

For the Zune Social features offered on your Xbox console, to change these settings go to the Zune music experience in the Music Marketplace and select me>Zune Account Management>privacy settings and select the “Be Part of the Zune Social” setting.

 

Family Settings and Parental Consent

Children under the age of majority in their jurisdiction of residence cannot create a Zune account without parental consent. Account creation will require the owner of the associated parent account to consent to the collection of information about the child. For children under the age of 13, this will involve the collection and verification of a credit card number in order to help determine that the owner of that parent account is an adult.

When the child account is set up, the associated parent account can set certain purchase and communication restrictions for the child account using Zune Family Settings. For more information about managing family settings go to Family settings in the help menu.

 

Feedback Program

The Feedback Program is a service used to improve the quality, reliability, and performance of Zune PC Software and services. Through this program, information about your PC hardware configuration, software installation experience, and how you use the Zune PC Software is collected and sent to Microsoft to identify trends and usage patterns. The program also collects information about errors that occur, such as where the problem happened in the software or hardware, the type or severity of the problem, files that help describe the problem, basic software and hardware information and past software performance and compatibility problems. The program reports might unintentionally contain personal information. If the Feedback Program is enabled, you will still be asked if you want to send the reports that may contain personal information. This gives you the opportunity to review such reports before sending them to Microsoft. Reports including files and data might be stored on your computer until you have an opportunity to review and send them, or after they have been sent. If an error report does contain personal information, Microsoft does not use the information to identify or contact you. To change the setting of this feature, go to Settings>software>Feedback Program.

 

Installation Information

In order to comply with certain licensing obligations, we collect some specific installation information when you attempt to install the Zune PC Software. Information we collect as part of installation includes standard computer information, along with Windows Product Identification Number (PID), how you installed this software (for example, from a CD or the Internet), whether it was a new or upgrade installation, and whether the installation is successful. This information is sent to a Microsoft vendor who tracks installations for compliance with Microsoft's licensing obligations.

 

Zune PC Software Updates

The Zune PC Software will periodically check for available updates. To do so, it sends standard computer information to Microsoft. If an update is found, you will be prompted to install it. Certain updates to the Zune PC Software are required to be installed to connect with Zune.net or to sign into Zune Marketplace. If you have subscription content, you will not be able to update your content licenses until you update your software. You may also manually check for Zune PC Software updates by going to settings > software > General > Software updates.

 

Device Software Updates

When you connect your Zune Device to your associated Zune PC Software, the Zune PC Software will periodically check for available Zune Device software updates. If an update is found, you may be prompted to install it. If you accept, your Zune Device will then be updated through your Zune PC Software. To maintain full functionality of all features on your Zune Device, you will need to install all updates.

 

Zune Device Wireless Features

Some Zune Devices are equipped with wireless capability which enables you to broadcast your presence and what you are playing and send content wirelessly between devices. To change the wireless setting on your Zune Device, go to settings> wireless.

 

Wireless Presence

Using the "Basic" setting displays your Zune tag or Zune Device name to other Zune Devices within approximately 100 yards. If you link your Zune tag to your Zune Device, then your Zune tag will be shown. If not, your Zune Device name will be shown. You can also display your Zune Device’s current activity, such as the currently playing song, podcast, video, radio station, or game, by changing your setting on your Zune Device at settings > wireless > presence.

 

Sending Content Wirelessly

If you decide to share content with another Zune Device user, your Zune tag or Zune Device name, the content and associated content information will be sent to the recipient to show that the content was offered by you. This information is stored in the Zune Device memory of the content recipient which could be shared with Microsoft depending on the user’s preferences.

 

Zune Device Error Reporting

You can choose to have the Zune Device send error report data if an error occurs. Reports may contain personal information, but reported information will be used only to diagnose errors – not to identify or contact you. For example, reports might contain a snapshot of your Zune Device memory, which could include the names and Zune tags of you and your friends, your recent activities, the contents of messages you were viewing, or data you recently submitted to a website. To change the setting of this feature, connect your Zune Device to your the Zune PC Software and go to settings > device.

 

Digital Rights Management

Zune uses Digital Rights Management (DRM) technology to preserve the rights of content owners who choose to protect their content using DRM. Content owners may also require the inclusion of unique identifiers in the metadata of protected content files. When you acquire protected content from the Zune Marketplace, you will also receive a DRM license at the same time that permits certain uses of protected content.

Updates to DRM components may be required to play protected content. To update DRM components, Zune will send a request to a Microsoft server containing standard computer information, troubleshooting information such as information about the last error code, information about the DRM components on your computer, such as their revision and security levels, and a unique identifier for your computer that is based on your hardware configuration. The Microsoft server uses this identifier to return a unique DRM update for Zune to install.

If the security of your version of Zune PC or Device Software is compromised, owners of protected content may request that Microsoft revoke your right to copy, display, and/or play protected content. Revocation does not prevent the play of unprotected content. A list of revoked software and hardware can be sent to your computer whenever you acquire content or log into the Zune Marketplace. If your version of the Zune PC Software or your Zune Device has been added to the revocation list, it will not be able to play secure content until you update the software to a more recent and secure version.

Marketplace

When you use the Zune Marketplace, we use analytics tools that collect information about page views, links that are clicked, and other actions taken on the site, such as search for content or requests to play content and errors that occur, such as content download and streaming errors.
